Cross Border Account Opening

The legal framework stipulates that several restrictions and exceptions have to be complied with concerning the opening of accounts and the execution of payments. In the following the most important features are listed:

Residents

  • are permitted to open Russian Rouble accounts abroad, however, subject to permission of the Tax Inspectorate of the country of origin.
  • are permitted to open Russian Rouble accounts with any Russian bank;
  • are permitted to open Foreign Currency accounts in Russia exclusively with authorised Russian banks;
  • are permitted to open Foreign Currency accounts abroad subject to notification of the Tax Inspectorate of the country of origin.

Special purpose accounts for Non-residents:

Non-residents

  • are permitted to open an unlimited number of Russian Rouble accounts with authorised Russian banks.
  • are permitted to open Foreign Currency accounts in Russia.
  • are permitted to open Russian Rouble accounts abroad subject to certain restrictions.

Depending on the transactions to be handled via the account, non-residents may opt between the following types of Russian Rouble-accounts:
- Current Account:
Used for settling Russian Rouble-based transactions, which do not have to be settled through special accounts. The immediate repatriation of Russian Rouble amounts in Foreign Currency is permitted.
- Special Russian Rouble Accounts:
Used for settling explicitly-stated transactions in Russian Rouble, which do NOT permit the immediate repatriation of Russian Rouble-amounts in Foreign Currency, i.e.:
- "A" - Account: Special account for the settlement of Russian corporate shares.
- "S" – Account: Special account for the settlement of trades in government bonds.
- "O" – Account: Special account for the settlement of corporate bonds.
- "V1" and "V2" – Account: Special trades in granting and receiving loans.

Special legal requirements creating administrational effort:

  • All documents (copies) issued abroad have to be certified by a notary public of the country of origin and legalised by the Russian Consulate in the country of origin or by the Consulate of that country in Russia. An APOSTILLE is also acceptable instead of the legalisation by a Consulate.
  • All documents for opening accounts in Russian Rouble, issued abroad, are to be translated into Russian. The signature of the translator is to be certified by a notary public of the country of origin and legalised as stated above. If the translation is done in Russia, no legalisation in needed. The translation is to be attached to the main document.
  • All documents (copies) issued in Russia have to be certified by a Russian notary public or by organisations which have issued the original documents.
